修復式正義深化環境影響評估法之初探

A Preliminary Study on Restorative Justice Enriching Environmental Impact Assessment Act

我國環境影響評估重大爭議不斷，其根本原因在於對環境影響評估法（以下簡稱環評法）根本理解的不同。本文借參照美國國家環境政策法，釐清我國環評法實為透過程序互動，以達成永續發展之實體動態目標。是以本文探索將具有以善意溝通，修補與建構關係之修復式正義之精神適度融入的可能，並點出環評法制融入修復式正義時須面對的糾結，依此提出環評法調整的建議，以期解決現有環評法的困境。

There have been incessant legal controversies concerning environmental impact assessment due to fundamentally-defferent understandings of of the Environmental Impact Assessment Act. This article, with reference to US National Environmental Policy Act, articulates that the core of the Environmental Impact Assessment Act is to utilize communication process to achieve the gole of sustantive and dynamic sustainable development. Therefore, this article further examines the integration of restorative justice into the Environmental Impact Assessment Act through the lenses of non-violent communication and restoration of constructive relationship, the essence of restorative justice, to point out its predicament and suggests the implementation adjustment of the Environmental Impact Assessment Act accordingly for effective resolution.
