中國式社會主義與著作財產權的交會──兼評安徽中級人民法院之著作權裁定文告

Do Fortune-Telling Websites Have No Copyright?: An Analysis of the Copyright Ruling of Anhui Intermediate People’s Court

關於著作權所要保護的法益，自現行大多數國家的著作權法觀察，都是屬於個人的財產法益範疇，但中國大陸的安徽銅陵中級人民法院，在二○一九年七月底審結的一件算命網站提供之服務業者所提起的著作權侵害訴訟，卻是以「不符合社會主義核心價值」作為不具著作權之認定，本文透過對於中國大陸的著作權保護目的之規定、社會主義精神與個人財產權的發展等面向進行分析，發見在中國大陸由於經濟制度的選擇，公有財產的地位大於私有財產，且私有財產是透過政策計畫篩選賦予，並非人民與生俱來的自然權利，而同時也為了促進公有財產所必要的市場活絡前提，人民的私有財產在近年來採取有條件地逐漸開放政策，從而只要是一個並非具有非法或政策所不允許的創作目的，且具有原創性和表現性等方面的成立要件的著作，就應該仍然能成為中國大陸著作權法所保護的著作，本文並援引中國大陸對於程式碼的特別保護為例，當算命網頁所含括的各項元素之產出目的，非有悖於倡導科學、反對迷信腐朽思想之「提供算命服務」，且該各項元素具備有原創性和其他著作權的積極要件，應該還是能夠具有著作權的保護之適格。

The Protection of Copyright Property, is for personal property pro-tect in most of the country. However, in 2019 July, there was a Copy-right Ruling made from Anhui Intermediate People’s Court, determined that has no Copyright inside Fortune-Telling Websites because of For-tune-Telling is not an encouraged behavior based on the Core of Social-ist Values in China. This Research analyzed the property protection by the purpose of Copyright Protection, the sprite of Socialist Values and the process of Personal Property development in China, to compare the rules of Copyright Property in China and other countries. Since China adopt the Socialist theory as her Economic System, the main policy is to protect and to development public property, personal property can only get protection while the government think that might be necessary to support public property grows. Therefore, to assess the Protection of Copyright Property in China, must to see both of the rules about the Copyright code and the core of Socialist Values, so that could make much more correctly judgments about how the Copyright Property been protect in China. And in the case of Fortune-Telling Website’s, there still might could have some Copyright been allowed while the type of works could be exist independently from the work which was violate the core of Socialist Values, because of the Protects to Source Code are no need to see the contents on Websides have Copyright or not, there still have values for individual rights in Copyrights.
