民法典推進了合同解除規則

The Improvement of Rules to Termination of Contract in Chinese Civil Code

相較於《中華人民共和國合同法》，《中華人民共和國民法典》在合同解除制度方面向前推進了一大步，如增設了不定期的繼續性合同解除的一般規則、合同僵局的破解規則、解除權的除斥期間、解除權人徑直訴請解除合同的法律效果，明確瞭解除通知發生法律效力的時間點，區別了權利／義務終止與權利義務關係終止，以及明確違約解除與違約責任之間的關係。

Compared with the Contract Law of the People’s Republic of China, the Civil Code of the People’s Republic of China has taken a big step forward in terms of the contract termination system. The new rules embodied in the latter are as follows: the addition of general rules for unscheduled continuous contract termination, and the regulation for breaking the contractual deadlock, the exclusive period for the execution of right to terminate a contract, the legal effect for termination of con-tract when the party claim directive to do so, clarifying the time point when the termination notice becomes legally effective, distinguishing the termination of rights or duties and the termination of relationships between rights and obligations, and clarifying also the breach of con-tract and its effects.
