從計畫行政看運輸計畫法制化

The Legitimization of Transportation Plan From the Prospect of Administrative Plan Law

行政計畫或行政計畫法，在法律規範體系上屬行政法重要之一環，更是行政作為法中不容忽視之行為[林明鏘，民85]，而行政計畫中又以運輸計畫對人民生活及國家資源運用之影響最為頻繁與重大。我國運輸計畫自民國六十五年完成「第一期台灣地區整體運輸規劃」以來，包括需求預測與評估分析等相關運輸規劃技術，均已有長足之進步。惟由於運輸建設涉及多數人之利益，更受人為因素與政治因素之影響頗深，導致專業之規劃理論與規劃過程，並未受到迫切的尊重，規劃結果亦易遭致扭曲，國家建設資源則常在政治角力中，輕易被消耗，因此，豆需建立一套通切之規範，規範運輸建設之擬定過程、計畫內容與決策程序，以提昇國家建設效益，增進人民生活福祉。本研究回顧相關探討行政計畫法之文獻，配合運輸規劃之特性與觀念知識，對運輸計畫法制化之迫切性，與法制規範之事項內容詳細探討，冀以尋求建立運輸計畫法制規範內容架構，彌補現行行政程序法中缺漏之遺憾。

Administrative plan, in more specific stated as Administrative Plan Law, is an important topic in Administrative Laws. It's also an important issue in the of Administrative Act. The transportation plan, which affects the allocation of national resources and peoples' lives, is one of the most important administrative plans. After more than 20 years, progressive improvements on transportation planning techniques of demand forecast and evaluation analysis have been achieved since “ The First Taiwan Area Integrated Transportation Systems Planning Study＂ in 1976. However, transportation plans, the products of transportation planning study which often concern lives and interests of people, are occasionally affected by the politics. Moreover, the proper process of planning has not been followed in several agencies, and the results form these planning process might mislead the alin ocation of national resources. To promote the efficiency of national transportation system investment and the benefits of people, it is necessary to establish an institution that legalizes the transportation planning process as well as its contents and decision making process This article reviews related literature and analyzes the characters of transportation planning， investigates the problems of the legitimization on administration law in Taiwan and details a proposed contents for the Integrated Transportation Law. Weexpect the proposed process can strengthen the Law of Administrative Procedural in transportation planning.
