整體運輸計畫體制化與法制化之初探

A Primary Study On Systematization And Legislation Of Integrated Transportation Plan

有鑑於目前整體運輸計畫因部門協調、法制化、經費或執行與內容等問題，尚無法達到內容綜合性、系統協調性、程序連續性、部門一致性、民眾溝通性等5C的整體目標，因此本研究就整體運輸計畫的體制化與法制化進行研究。本研究首先探討我國整體運輸計畫體制問題，分析運輸計畫與都市計畫的關係，並嘗試重新建立適當的整體運輸計畫體制與作業內容，加強各計畫間之縱向與橫向的整體協調。其次本研究進一步分析法制化方式，透過加強各運輸系統法規的規劃程序與內容、制定整體運輸計畫法、訂定運輸計畫的委任命令、訂定運輸計畫規範的職權命令及訂定運輸計畫的行政規則等五種法制化方式之探討，研析我國整體運輸計畫體制未來的法制化方向。本研究最後並建議法制化的短、長期工作項目，以逐步落實整體運輸計畫體制，並達到綜合性、協調性、連續性、一致性與溝通性的理想目標。

Because current integrated transportation plan lacks in comprehensionof contents, coordination of physical plan system, continuity of planningprocedure, consistency of different sector, and communication with citizen, thisarticle focuses on the integration transportation system and it's legislationissues. This article firstly explores current transportation planning problemsand the related regulations, analyzes the relationship between transportationplan and urban plan, and tries to reestablish an adequate transportation plansystem and its mechanisms. Then, it discusses the promotion methods forlegislation of integration transportation plan system. Based on the discussionof adjustment of current laws and regulations, institute of `transportation planlaw', establishment of commission command, conclusion of plan standard, andintroduction of administrative rules, it draws up the legislation direction ofintegration transportation plan system in future. Finally, the steps and itemsof short-term and long-term are suggested for implementation of a comprehensive,coordinate, continuing, consistency, and communicative transportation plansystem.
