論質詢程序中的“决定”

On “Decision” of the Inquiry Process

質詢是人民代表大會行使監督權的一種重要方式，而人民代表大會及其常委會對質詢程序的“决定”，在整個質詢程序中顯得尤爲重要。人民代表大會及其常委會質詢程序中的“决定”是在對質詢案進行形式審查的基礎上，同時“决定”了答覆的形式和場合。其“决定”屬程序性措施，而非實體性結論。其“决定”對質詢權進行了合理的限制，法律應爲“决定”提供救濟。其“决定”的過程必須公開。

The inquiry is the most important way of supervise on the People’s Congress. On the People’s Congress, the decision of the inquiry process plays a very important role. On the inquiry process, the PC and the Standing Committee of PC reviews the form of inquiry cases, and deicides the means and location. The decision is a measure of process, rather than conclusion of substance. The decision makes a reasonable restraint on inquiry. The law should provide remedy for for the decision. Meanwhile, the process of deciding should be promulgated in public.
