給付遲延中之給付不能亦是遲延損害

Impossible Performance in Defaults Is also Defaults Damages

遲延損害是財產上損害，給付不能本身是財產上損害，遲延損害以給付遲延為發生原因，給付遲延中之給付不能因此是遲延損害。債務人過失客體原則上是債務不履行、權利或利益之侵害，而非損害。債務人陷於給付遲延，且就遲延有過失者，即應賠償因遲延所生之損害（包括給付遲延中之給付不能），縱使就遲延損害並無過失。這項損害賠償責任，因此是過失責任。

Defaults damage is damage on property. Impossible performance itself is damage on property. The defaults damage is occurred from the defaults. Therefore, the impossible Performance in defaults is the defaults damage. The object of debtor’s negligence is in principle non-performance of obligation (including defaults) or injury of rights or interests, but not damage. If the debtor comes to defaults and is only negligent for the defaults, but not even negligent for the defaults damages, he should be liable for the defaults damage (including impossible performance of obligation in defaults) that was caused by defaults. This liability is therefore a negligence liability.
