On January 24, 2018, Article 82 of Medical Care Act was amended to stipulate clear requirements for the determination of liability for negligence in medical conduct. The establishment of medical negligence requires ''failure to exercise medically necessary care'' and ''failure to exercise reasonable professional clinical discretion.'' This amendment takes into account the professionalism, complexity, and unpredictability of medical behavior, and thus tightens the standards for identifying medical negligence. The focus of this article is mainly to explain the interpretation and application of Article 82 of the Medical Law. In addition, the current status of judicial decisions after the revision of the law is also discussed. |
