國民體育法修法對學校體育相關法制規定之影響

The study of the Influence of amendment of the national sports law to the legal regulations related to school sports

國民體育法是體育行政最重要的法源依據，106年9月20日修正發布後，計有42個授權法規需要配合修正，其中包含與學校體育政策相關之規定。因攸關學校體育政策之推行，本文透過文獻分析，探討國民體育法修法後對於學校體育法制規定之影響。首先探討國民體育法修法之沿革，瞭解其對於學校體育法制規定之重要性；繼之，經由學校體育政策制定之理論模式，說明學校體育法規修正之程序；然後，探討檢討學校體育法制規定修法的重點及影響；最後提出國民體育法修法對於學校體育法制規定實務方面之建議。

 

The national sports law which is the most important Legal basis to all the sport affairs in Taiwan was revised and announced on September 20, 2017, then 42 regulations need to be amended at the same time and some of them relate to school sports policies. Due to the regulations will affect the enforcement of school sport policies very much, this study is to explore the influences of the amendment of the national sports law and the related legal system to school sports by analyzing the literature and documents and discussing the review of the school sports regulations. In the end, this study puts forward suggestions on the practice of the Sport Administration, Taiwan as well.
