This article focuses on the same-sex provisions under the German Civil Code, examines the interpretation questions caused by directly expanding the qualification for marital parties, points out the difficulties of applying provisions of the blood relatives’ chapter, and explains the possible consequences when moving from the Same-sex Couple Registration Act to same-sex marriage. In the meantime, this article will clarify the scope of legislative task assigned by the J.Y. Interpretation No. 748, review the current draft bill (including enacting a special law or an amendment to the Civil Code), and wish that we can finalize the legislation based on the Germany’s experience, which will conform to the structure of the Family Part of the Civil Code and balance same-sex couples’ rights for marriage and family. |
