地方政府在綠能發展與管理之可行性分析

The Analysis on the Possibility of Local Government in the Development and Administration of Green Energy

發展綠能已成為地方政府之重要施政規劃方向，然而，涉及中央許多法令規範，亦須面對不同主管機關具體解釋及適用法令之態度，經由檢討相關案例之經驗，應特別注意各主管機關適用中央與地方法令之共識，避免不同法令主管機關因各自依法行政及嚴格管制農業設施之固著物結構，卻造成投入綠能參與者之困境。本文經由實務個案之檢討，體會地方政府之綠能發展與管理，仍需注重分析及調合中央與地方主管機關對於綠能實踐之共識，始能具備確保合法且永續發展之可行性。

Development of green energy is the vital policies and measures of Local Governments. Nevertheless, it should follow central laws and regulations and depend on the interpretation and application of different authorities. By reviewing relevant cases, this article finds different authorities restrict agricultural facilities by interpreting the law variously. To tackle with the obstacle of green energy, the consensus of the authorities in the interpretation of central and local laws and regulations must be reminded. By reviewing the practical cases, this article realizes local governments must make an effort to analysis and reconcile the interpretation in the green energy practices, which makes development and administration of green energy follow the laws.
