太陽花運動後的國會改革展望

The Perspective of Legislative Reform after the Sunflower Movement

如果一個國家的國會不能正常運作，而該國之人民卻又以其民主而自傲，此乃是一件荒謬之事。臺灣的政客與菁英總是一致性地宣稱：在其心中，民主乃是最高價值。但是一旦涉及立法事項，他們卻甚少遵守國會議事規則。這也正是太陽花運動的抗議者，譴責國會失靈的主要原因。本文嘗試分析我國國會運作之困境與弊病所在，並在不修憲的情況下，提出可能的改革方案。文中第一部分處理國會內部關係，包括議事紀律，議事杯葛與議長警察權皆在討論之列。第二部分則處理國會外部關係，包括國會與行政權，以及國會與公眾之相互關係；最後以提出主要的改革方案作結。

If the Parliament of a country cannot work normally, its people’s pride of his democracy is ridiculous. Taiwan politician and elites unanimously assert that the democracy is the highest value in their mind. But when they touch the law-making issue, they respect rarely to the rules of legislative procedure. This is the reason why the Sunflower’s protesters accused the Parliament of suffering the parliamentary failure. This paper aims to explore the factors of parliamentary dysfunction and the perspective of its reform without amending the constitution. The interior order of Parliament and the speaker’s power will be discussed in the first part. Then the parliamentary exterior relations vis-à-vis the executive power and the public will be analyzed in the second part. The reform program and the main suggestions are proposed at the conclusion.
