In recent years the cultural and creative industries have already become an emerging industry full of business opportunities, and cultural and creative products spring up like mushrooms after the rain. However, the largest benefiters will not be the creators, but the imitators without the protection of intellectual property rights. This study was carried out through content analysis and interview methods focusing on the exploration of the protection of intellectual property rights law, trademark act, copyright rules and trade secret law on cultural and creative products. The implementation status and problems of intellectual property management of the cultural and creative product enterprises, and the intellectual property management strategy which should be adopted by them were explored. It aimed to understand the protection levels on cultural and creative products of Taiwan’s intellectual property rights and to deduce the intellectual property management strategy, providing a concrete execution reference for the cultural and creative product enterprises on the intellectual property protection and management and protect designer’s creation to effectively develop cultural and creative economy. Through this study, it was also hoped to make more designers understand and value the protection of the intellectual property rights on cultural and creative products. The results revealed that smaller enterprises cared less about the importance of intellectual property rights, and most of them had the attitude that intellectual property rights may or may not be needed. However, larger enterprises paid more attention to the protection of intellectual property rights, but for the follow-up dispute dealing they almost deemed that it is not easy to deal with due to time-consuming and money-consuming, and not worth doing it. In addition, this study also proposed an intellectual property management strategy according to the development process of cultural and creative products. It concretely provides cultural and creative product enterprises the ways should be adopted and implementation suggestions of intellectual property management during the development process of cultural and creative products. |
