以妨害司法罪健全羈押與防逃機制之探討

A Discussion on Prevention from Escape and Reform of Detention via Enactment of Obstruction of Justice

現行刑事訴訟法並未明確有罪判決確定前防逃機制，應如何預防重罪被告於判決確定前逃亡，以維護司法正義，確實是實務上一個棘手的難題。而就法制面而論，究應如何調整刑事訴訟法之相關規定，以健全羈押與防逃之機制，更是刻不容緩之議題。為能詳明我國刑事訴訟法制於羈押與防逃機制之不足，本文擬借鏡美國羈押法制與妨害司法罪等發展經驗，以為我國相關法制修正之參考。

The current Criminal Procedure Code does not provide any rule against escape after conviction so that how to prevent the convicted felons from escape before the conviction become final is a serious problem while pursuing the criminal justice. As the legal framework is concerned, how to amend the Criminal Procedure Code to better the institution against escape is very urgent. This study tries to review relevant legal background in the U.S. regarding developments of detention system as well as the offense of obstruction of justice, to which the criminal justice system in Taiwan may refer.
