The Effects of Vorurteil on Judicial Behavior: a Psychological Angle

在心理學中，哲學解釋學裏的“前見”問題被細化成對人格、圖式和偏見等問題的綜合研究，而前見是如何具體影響主體的解釋過程則體現在啟動效應、心理定勢、首因效應、暈輪效應等一系列心理學研究成果中。這些心理學中的前見對於作為一種解釋過程的法官審判行為以及最終的審判結果產生著各種正面或負面的影響，因而需要通過司法制度的細化和改進來分別予以引導和制約。

In Psychology，the issue of Vorurteil，which is a concept of Philosophical Hermeneutics，is articulated with the issues of the interpreter’s personality，prejudice and schema.And the question “how vorurteil affect the interpreter’s behavior ” is answered by some psychological studies，such as the priming effect,the mental set，the primacy effect and the halo effect.Due to These “Vorurteils” in Psychology may have various effects on the Judicial behavior even the judgement of a judge，we need to fully utilize the positive effects and reduce the negative effects by reforming and improving our judicial system .
