情感是社會結構以及文化生成的主要承擔者。但由於以往法學研究的基礎框架大多建立在情感與理性的兩分哲學之上，因此情感在法律中的作用大多被忽視或遺忘。對法律中的情感因素的關註始於哲學家的思考，並繼之以法律心理學的實驗探索。20世紀90年代中期以後，在由一批法律、社會學、認知科學等方面研究者所主導的學術運動的影響下，以情感為話題的法理學派開始逐漸成型，研究的涉及面和深度得到提高，逐漸脫離了二分法經驗主義的局限，轉而發展自己獨特的解釋和研究框架，學科之間的研究也從原來的平行化發展，逐漸呈現出交叉性的態勢。

Emotion is the most important part in the structure of society and culture.But the role of emotion in law was ignored for most of legal research was built on the divide of emotion and reason.The research of emotion in law begins with the thought of philosophers，and continues with legal psychology.After 1990，the research on emotion has improved，which break away from the limit of division，and begins to develop its own framework.
