配套立法：授權條款支配下的“次級”立法

Supporting Legislation: Secondary Legislation Governed

作為“初級”立法授權條款支配下的“次級”立法，配套立法現象彰顯立法主體之間認識上的主客體關系、地位上的主次關系、時序上的先後關系、效力上的層級關系以及內容上的銜接關系。配套立法承載著保障法律實施、促進科學立法和完善法律體系等實際功能。同時，配套立法亦應遵循既定的授權原則和特定的運行規律。配套立法權的濫觴，不僅不利於法律的實施，而且還會破壞立法秩序、傷及法律的權威，甚至還可能動搖一國統一的法制原則。在現代法治條件下，配套立法行為不能缺少相應的監督機制對其加以規制。

Supporting legislation is an outstanding practice of special nature in the Chinese delegated legislation field at the present stage.It reflects the established relationship between subject and object in cognition，relationship between primary and secondary in position，precedence relationship in time，hierarchical relationship in effect and cohesive relationship in content.As “secondary (or delegated) legislation” governed by the enabling clauses of the “primary legislation”，supporting legislation plays a practical role in guaranteeing law enforcement，promoting scientific legislation and improving legal system.Meanwhile，supporting legislation needs to follow the established delegation principles and specific law of operation.The abuse of supporting legislative power is not only harmful to law enforcement but also disrupts legislation order and undermines the authority of law and even shakes the uniform principle of legality in China.Under the modern “rule of law” condition，corresponding legal supervisory mechanism is indispensable for the guarantee and regulation of supporting legislation.
