Warranty of the Goods of Sale —Study on the Recent Fundamental Cases of Article 354 Taiwan Civil Code

This paper illustrates the basic theories related to the three kinds of defects of the goods sold that are laid down in Article 354 Taiwan Civil Code. In addition, by referring to the recent Taiwan Supreme Court’s judgements and in order to explore the fundamental court cases associated with the said Article, this paper analyses the defect types that frequently occur in the sales of moveable and immoveable goods. The duty of seller and house sale’s broker to inform, and the supplementary nature of the provisions of warranty for defects are also analyzed.
