The development of information technology and information society has resulted in the necessity of legal protection of personal information. This article focuses on legal protection of personal information of consumers in Mainland China. Firstly, this article starts with analysis of current legislations, including discussions of legislative definitions and legislative backgrounds. Then, this article analyses practices of such legal protections by introducing relevant judicial decisions and administrative enforcement status. Furthermore, this article points out deficiencies of such legal protection, viewed from law making and law enforcement point. In the end, this article ends with suggestions about expectant improvements of such legal protection in Mainland China, including a new interest balancing between business operators and consumers, multiple protection mechanism for consumers, and public awareness of such protection. |
