作為最高人民法院行使司法權的重要內容之一，司法解釋對保障法律法規在審判活動的統一理解與適用，促進我國法律體系不斷健全完善都起到了積極作用。在司法解釋的發展和演化過程中，這種具有“中國特色”的制度設計的角色定位、效力範圍，以及它在司法權、立法權配置中的法律地位都值得深入研究。隨著司法改革的全面推進和逐步深化，最高人民法院在總結實踐經驗的基礎上對司法解釋的規範化、體系化推出了一系列有益的改革舉措，而這些舉措也引發了學界對司法解釋的定位調整和功能重構的進一步思考。

As a key component of the judicial power exercised by the Supreme Peoples Court, the judicial interpretation plays an essential role in clarifying definitions of vague provisions, unifying the application of law in practice, and more importantly, promoting the further development of Chinas judicial system. As a unique institutional design with ‘Chinese characteristics’, the varying roles, effects as well as the legal status of the judicial interpretation in the power interactions between the judiciary and legislation are all worthy of further study. With the deepening of the judicial reform in China, the Supreme Peoples Court has promoted a series of judicial reform measures concerning the standardization and systematization of the judicial interpretation power in recent years, which in turn triggers further discussion on redefining the roles and functions of the judicial interpretation.
