德拉瓦州商業法院之設立及啟發

The Inspiration form Establishment of Business Courts in Delaware

雖然在二○一○年以前，德拉瓦州透過衡平法院與高等法院對於商業事件管轄及審理之分工合作，獲得各界之高度評價及讚揚，但德拉瓦州高等法院在二○一○年復成立複雜商業訴訟法庭，設置獨立專責之商業法庭，對商業事件之管轄及審理展開歷史新頁。本文首先介紹美國德拉瓦州各級法院對於商業案件之分工狀況及管轄範圍。其次，說明德拉瓦州高等法院於二○一○年設置複雜商業訴訟法庭之發展歷程及管轄範圍。最後，對於我國應如何籌劃設置商業法庭提出具體建議。

Before 2010, due to the mutual cooperation of the Delaware Court of Chancery and Superior Court, both of them distributed sound commercial dispute-resolution mechanisms, and deserved high evaluation and praise. Nevertheless in 2010, the Delaware’s Superior Court re-established a new independent dedicated business litigation division, it is to the complex commercial litigation Division, to hear and handle the jurisdiction of business disputes and obviously has opened a new page of history. First, this article introduces the extensive corporation of Delaware’s court structure and then describes their jurisdictional allocation of business cases. Second, this article indicates that the development and jurisdiction of Complex Commercial Litigation Division formed by the Delaware’s Superior Court in 2010. Finally, this article will make specific recommendations of how to plan for setting up business courts in Taiwan.
