Equality is the main trend line of modern legal reform in family law. Both the common ownership system and the claim system are based on the idea of substantial equality. In the context that the supporting obligation is separated from the matrimonial regime, the claim system is consistent with the sharing principle. The legal relationship between spouses has evolved from coverture scheme to partnership with independent personality. The claim system properly reflects this evolvement. It also eliminates the dilemma which lies in the process of establishing rules which determine the natures of property and debts between husband and wife. From the outside perspective, it corresponds to the purifying progress of ownership, promotes the circulating of property and protects the transaction security. In addition, it coordinates with the trend of women’s participation into social affairs. The return of family law to civil law warrants such a system.
