On the Meaning and Nature of FRAND Commitments

產品複雜化與多樣化的結果，不同產品之間的相容與互通，變得重要，標準制定成為科技社會的常態，共同制定標準有助於減少歧異並確保品質，便於技術標準的普及化。若標準所採用之技術，具有專利權保護時，專利權人即可能藉機挾持，遂行濫用行為，為防止專利權人於標準制定中隱瞞專利或濫用專利，會要求專利權人揭露專利並為FRAND授權聲明，讓專利權人受到自我拘束，避免專利權成為技術使用的障礙，達成標準化之促進競爭目的。

The variety and complication of products contribute to the importance of compatibility and interflowing of different products. In order to ensure the quality and reduce difference of products, standard setting is a common phenomenon in technology society. If the technique in standard setting is protected by patent law, the hold-up problem arises. To avoid patent ambush, standard setting organization requires patentee to disclose patents and to make FRAND commitments. Patentee will be restricted by himself in order to avoid an obstacle to technique use, and the goal to promote competition by standardization will be achieved.
