民法典應設立三種動產用益物權

The Civil Law Should Establish Three Categories of Usufructuary Rights of Personal Properties

本文對《中華人民共和國物權法》第117條規定的動產用益物權作了種類研究，提出未來的《中華人民共和國民法典》應設立融資租賃用益物權、信託動產使用權、公共資源專用權三種動產用益物權。這三種動產用益物權不僅能夠滿足現代社會的經濟和生活的需求，而且能夠推動大陸法系物權法的現代化。

The article researches the types of Chattel Usufructuary Right on the 117th provision of Real Right Law of the People’s Republic of China, claims that the financial Leasing usufructuary right, the trust chattel right and the exclusive rights of public resources should be established in the coming Civil Code of the People’s Republic of China. These three kinds of Chattel Usufructuary Right can not only meet the economic need and social life demands in modern society, but also promote the modernization of real right law of the Civil Law System.
