論一八一四年Thibaut與Savigny間關於民法法典化的爭議

On the Codification Debate between Thibaut and Savigny in 1814

本文目的為介紹發生於一八一四年間的一件法律史事件，即當時德意志地區兩位重要的法學者Thibaut與Savigny間，就是否應該立即學習法國民法典為德意志地區訂立一部統一的民法典所產生的爭議。本文首先介紹這場爭議的發生緣起，然後分析雙方的主要主張，最後則介紹該事件所產生的歷史後果，以及提出本文對該事件的評價，希望藉此讓臺灣的讀者可以對於此重要的歐洲法律史事件有一初步認識。

The purpose of this paper is to introduce an important event in Germany’s legal history, also the codification debate between Thibaut and Savigny in 1814. The main issue of this debate is, weather German should at that time make an unified Civil Code in the example of Napoleonic Code. At first describes this paper the cause of this debate, then analyze the main stand of Thibaut and Savigny, and finally summarize the history significance and assessment of this important historic event.
