臺灣高雄地方法院一○四年度第一次人民參與審判案件模擬法庭心得報告──兼評司法院「人民觀審試行條例」草案

A Report of Taiwan Kaohsiung District Court’s First Moot Court of Citizen Participation in the Justice System in 2015 and the Proposed Regulations of People Lay Judge System

筆者擔任高雄地院一○四年度第一次人民參與審判案件模擬法庭之評論員，經過三天全程參與觀察法庭活動，不僅對於如何將觀審訴訟制度落實到實際的法庭活動有進一步的體認，更對於觀審員與職業法官一起坐在法庭上聆聽當事人及證人的陳述，一起討論事實認定、法律適用及量刑之心路歷程有所體悟，乃不揣譾陋，以刑事審判工作者之角度，就模擬法庭中觀審法庭之表現提出粗淺看法，並就司法院「人民觀審試行條例」草案之規定提出評析淺見。

After serving as a commentator for Taiwan Kaohsiung District Court’s First Moot Court of Citizen Participation in the Justice System in 2015, the author not only gained better insight on how to implement lay judge system into practice, but also had further understandings for the decision-making process between lay and professional judges. Hence, the author attempts to propose some suggestions of lay judge system in Moot Court and Judicial Yuan’s Proposed Regulations of People Lay Judge System with personal working experiences in criminal judiciary proceedings.
