論日本自民黨2013年憲改草案所建構的軍事憲法體系

A Study on Military Constitutional System of Japan in Construction and Practice from the Amendment Drafts by LDP 2013

日本自民黨於2012年5月公布「日本國憲法改正草案」，包括憲法前文在內的現行憲法全部條項均予修正，全文由十一章一百一十個條文所構成，其中所增修的軍事條文可比擬德國基本法中歷年所建構而成的軍事憲法體系，為了澄清各方諸多疑慮，自民黨復於2013年10月另公布增補版，依日本目前國內政治環境以觀，如欲通過此一「全面性憲改條文」，時機上恐尚未成熟，憲改草案雖恐有隨時修正之可能，對此，仍先予探究，以窺探日本軍事憲法變遷之脈絡與未來走向。

The Liberal Democratic Party of Japan has advocated the crafting of a revised constitution for Japan in May 2012. All articles of the present constitution from the preamble to the provisions have been reviewed and revised. The revised draft is composed of eleven chapters, 110 articles in total, including many military articles which like the military constitution system in Germany Basic Law. The new version of the draft amendment was published in October 2013. It shall still hard to be approval in the near future. Through survey of the Amendment Drafts by LDP and the present Constitution hopes to reconceptualize the transition of Japanese military constitution system.
