21世紀是設計經濟的時代,著作人將創意、知識、價值導入設計企劃,進而以文化詮釋商品的附加價值,成為臺灣經濟及形象發展之戰略,也是臺灣企業進軍國際市場提升競爭力之核心元素,使得民眾對藝術的品位與對各種文化,有更進一步之認識與賞析。本文以智慧財產權作為論述核心,包括臺灣的“專利法”、“商標法”及“著作權法”等法規,分析創意文化產業如何應用這些智慧財產權法規。本文先以介紹臺灣“文化創意產業發展法”的立法目的、體系架構及保護範圍。其次闡述如何以“專利法”、“商標法”及“著作權法”保障文化創意產業之成果。此即結合法律與文化創意特性,尋求對產品保護範圍的最大化,應用法律捍衛設計師辛勤創作後的結晶,企求文化產業之成果,得以搭配企業設計策略,經營出自身的品牌,促進臺灣設計產業的競爭力。
英文摘要
It is a hot point of the design with economic, the authors will introduce creativity, knowledge, and value of product into the design planning, and then the cultural interpretation is an added value of product However the image of the country through the design development and economic development strategies, but also industries to enter the international market, and the core elements to enhance the competitiveness of cultural product made in Taiwan, Moreover, the artistic taste of people and the understanding and appreciation for variety cultures will upgrade The objective of this paper is taken to intellectual property rights as the core, including patent law, trademark law and copyright law and other regulations of Taiwan, analyze how to use these intellectual property rights on cultural creative product This article first introduces the development and the purpose of Cultural Creative Industry Development Act, and the architecture and the scope of protection The second section describes how to patent law, trademark law of Taiwan and copyright law protection of cultural and creative product, Further combined with the cultural and creative legal characteristics, to seek the scope of protection by intellectual property rights, and application of the law to defend the property right and personality rights of creative designer I hope the outcome of the cultural industry, able to match intellectual property, operating out of their enterprise brand, and promote the competitiveness of the design.
