智慧財產權保護對授權收支之影響

Relation between the Intellectual Property Right Protection and the Balance of Royalty and License Fees

近年來智慧財產權保護議題沸沸揚揚，然而，多數偏向於法學內涵與契約條款，很少從授權產業的收支價值切入。因此，為實證探究智慧財產權保護和授權收支之間的關係，本研究彙整相關文獻，應用階層線性模式加以驗證。本研究結果發現，智慧財產權保護對授權收支具有正向的影響，另外，總體經濟發展程度也會對授權收支產生脈絡直接效果。因此，本研究建議各國除了建構完備的智慧財產權保護制度外，也應重視相關總體經濟變數也會對授權收支產生脈絡影響。

Research on intellectual property protection has increased noticeably in recent years. However, while some works are available on law clause of property act, little information is available on the balance of royalty and license fees. Thus, this work used the hierarchical linear modeling to consider the relation between the intellectual property protection and the balance of royalty and license fees. Overall, the results indicated that both the intellectual property protection and the macro-level economic development positively related to the balance of royalty and license fees. Thus, this work suggests that every country should not only improve the regime of intellectual property protection, but also pay attention to the other factors of macro level economic development could affect the balance of royalty and license fees.
