析論犯罪被害人參與少年司法程序之爭議──借鏡德國少年刑事程序法制

Victim Participation in the Proceeding of Juvenile Justice in Taiwan: A Lesson from Germany's Juvenile Criminal Justice

本文討論刑事訴訟法增訂被害人保護與參與程序的新規定後，相關規範能否適用於少年司法程序的問題，主要討論視角則是透過比較德國法的觀點進行分析，除了介紹德國法上的爭議與討論外，也進一步檢討我國法上，各種不同類型程序參與權應用於少年司法程序的可能性。

This article discusses the victim participation in the proceeding of juvenile justice after the recent amendments of Taiwan's Criminal Procedure Act concerning extension of victim protective measures. Since the victim participation includes different forms, the author tries to analyze these difficulties through comparative studies on Germany's provisions and practice of juvenile justice so that a satisfying resolution might be found.
