漁港內休閒垂釣管理之研究

A discussion about drafting the regulations for recreational fishing in fishing harbor

現行漁業法規並未建立漁港內休閒垂釣的管理依據。為解決此問題，本研究就相關法令進行探討，建議主管機關應考慮漁港內休閒垂釣的行為特性，與其他現行法規的相容性，建立依法行政的依據。透過明確的法令規定，提供國民應遵守的行為準則，不僅是順應責任漁業行為之國際潮流，更是國家推動永續發展漁業的政策目的之必要措施。

The current fisheries act and regulations do not set up any provisions to manage the recreational fishing activities in fishing harbor. In order to solve the issue, the fishery authority should consider the characteristics of recreational fishing in the fishing harbor, and the legal compatibility with other existing regulations to draft the regulations. Through the clear definition and relevant provisions to administer the recreational fishing activities in fishing harbor are not only corresponding to the international trend of responsible fisheries, but also demonstrating the necessity to promoting the national marine policy purpose for sustainable fishery
