試論國家獎助藝術之基本原則及其手段

歌手陳妍希出唱片，獲得文化部350萬元的補助款，引起藝文界人士的批評，因為補助款的高低似乎是以知名度來決定。由此案例可以看出，國家獎勵或補助藝術，具有高度的爭議性。因為國家是否能判斷那些藝術值得補助？以及補助的金額該如何決定？都是個爭議性的議題。文化藝術獎助條例對於藝術活動的獎助，是否符合憲法的價值決定？本文從憲法的觀點，發現文化藝術獎助條例對於藝術活動的補助，不符合多元文化的國家目標，藝術的補助應由中立的第三者執行，而不應由行政機關來執行。
