國家公權力介入家庭後的衝突關係：以兒少保護為核心

家庭作為社會最基本的單位，有其固有功能，且縱使家庭功能日益變遷，但是，家庭的社會化功能與情感功能仍不可取代。所以，為保持家庭發展的特殊性，家庭擁有自主性，也就是說，家庭為私領域的一環，國家公權力不應輕易的介入。但是，兒少是家庭權力結構中的弱勢，因此，國家的公權力得基於兒少保護而介入家庭領域，也就是說，兒少保護為國家公權力介入家庭的的公益理由。而且，當國家基於兒少保護介入家庭後，國家公權力勢必與兒少權利、父母親權產生衝突。就此，本文試圖對國家公權力、兒少與父母的權利衝突關係，劃出其應有的框架。

Family, as the basic unit of society, has its inherent function.Even though the role of family varies from time to time, its functions, such as socialization and emotional support, cannot be replaced. Hence, to maintain the valued character of development of family, we should its autonomy. Namely, family, belonging to the private field, should not be intervened by public power of nation state.However, teenagers are the minor group in a family, children's protection becomes the target of this article. Therefore, children's protection is for the public's good, nation state has justification to meddle in the field of family. At last, when nation state intervenes in families due to children's protection, there is a conflict among nation state's public power, children's and parental rights. In order to settle the conflict, the article attempts to build up the framework that regulates the relations among public power, children's and parental rights.
