國民參審「傳聞法則」變革與展望－－「警詢筆錄」之檢討為中心

Study on hearsay rule changes in the people's-participating-in-the-trial system. ～ focus on 'police interrogation transcript'

司法院規劃「人民觀審」制度，藉由一定方式選出的人民擔任「觀審員」，就特定重罪案件全程參加第一審程序，提升人民對於司法信賴，確保判決結果能貼近民意，並增進人民對司法的了解。考量參與國民參審的一般民眾，「無」法律知識，「無」訴訟經驗、「無」專業訓練、「無」充分時間，故如何建置簡便、親民、易懂之司法審判程序，得以吸納民間多元價值、反映人民觀點，乃國民參審規範設計關鍵前提。刑事審判程序中傳聞法則相關制度變革乃屬重要關鍵，本文參考日本國民參審相關配套設計運用，研擬呼應國民參審相關機制應有變革，以期深化「國民參審」司法改革，回應社會大眾對於司法民主期待。

To acquire people's trust for justice, ensure the verdict close to the public majority opinions, and to enhance people's understanding of justice, Judicial Yuan has planned the system of people allowing people to view examining the trial on specific felonies. However, most people who are not law professionals have no trial experience, no interest and no time for participating. Hence, how to build a simple, friendly and easy for people to understand the judicial proceedings, becomes the key premise of constructing the people's-participating-in-the-trial system. Hearsay rule changes are the key point in criminal proceedings. The article would like to compare to Japanese relevant hearsay rule designs, and review the necessary changes of our rules of evidence, to deepen the judicial reform in response to people's expectation on judicial democracy.
