This paper firstly discuss the latest development with regard to the law of environmental impact assessment in the joined cases of Certain Activities Carried Out by Nicaragua in the Border Area (Costa Rica v. Nicaragua)/Construction of a Road in Costa Rica along the San Juan River (Nicaragua v. Costa Rica). Secondly, it compares the debate between Judge Donoghue and Judge ad hoc Dugard’s separate opinions. Finally, it argues that the role of international courts and tribunals in the development of environmental impact assessment should have reached its limit. |
