論原住民族傳統智慧創作之使用倫理

原住民族傳統智慧創作保護條例（2007）及其子法（2015）已完成立法，其立法目的為促進原住民族文化之發展。今後只待各原住民族就其智慧創作提出智慧創作專用權之申請並取得登記，日後即可就侵害專用權之情事主張權利，期待能夠減少以往對於傳統智慧創作誤用及濫用情事，進一步落實原住民族文化之保存。但是，本法並未提出如何妥善使用傳統智慧創作以尊重原住民族文化，以教育主流社會大眾使用傳統智慧創作之妥適方法，使得使用行為不至於有侵害智慧創作專用權之虞，甚至侵害專用權。本文提出「原住民族傳統智慧創作之使用倫理」，目的即在論述傳統智慧創作應如何妥善使用，方能尊重原住民族文化。因而，本文由論述傳統智慧創作使用倫理之意義、重要性、功能為始，並從原住民族的部落習慣法出發，闡述原住民族傳統智慧創作使用倫理之內涵，最後並提出原創條例第16條的修正建議，以及歸納部落習慣法為「原住民族傳統智慧創作之使用倫理準則」供人們參考與遵行。 The Indigenous Traditional Cultural Expression Protection Act (ITCEPA) of 2007 is a sui generis law aimed at safeguarding indigenous cultural expression in Taiwan. The legislation, with its set of two accompanying administrative regulations, has not only helped to ensure, the protection of indigenous cultural expression, but has also helped to promote the viability of native cultures within the region. By registering traditional intellectual creations, indigenous peoples can claim exclusive rights to their intellectual property in the event that incidents of cultural appropriation take place. However, the legislation does not mention what the best practices of indigenous traditional cultural expression are. This makes it difficult to create standards that people can follow. Therefore, the author proposes a new framework for establishing best practices of Indigenous Traditional Cultural Expression that utilizes tribal common law to promote native culture. In the beginning, she discusses the meaning, significance, and function of best practices of indigenous traditional cultural expression, exploring the significance of indigenous traditional cultural expression best practices embedded in tribal common law. Finally, the author proposes legislative amendments for Article 16 of the Indigenous Traditional Cultural Expression Protection Act and best practice guidelines for indigenous traditional cultural expression for reference for indigenous traditional cultural expression practice.
