由美國Med-Arb經驗論應用於臺灣醫療糾紛之可能性

A Possibility Research of Applying Med-Arb from the U.S. Experiences to Medical Malpractices in Taiwan

目前，臺灣針對醫療糾紛之處理係採取訴訟與ADR之雙軌制度。本文參考美國將ADR選項中之Med-Arb方式適用於處理醫療糾紛之經驗，探討臺灣目前在法制與現況因應上之可能性。無論Med-Arb或僅以調解或仲裁方式進行醫療糾紛之處理，本文認為目前已有使用Med-Arb之機會，唯仍主要考驗著臺灣社會對於以ADR方式解決醫療糾紛之接受意願與信賴程度。 Litigation or ADR are the two main sources of dealing with medical malpractices in Taiwan nowadays. Med-Arb experiences, one option of ADR in the U.S., are applied in this article to discuss the possibility of dealing with medical malpractices in terms of legal system and current situation. No matter Med-Arb or single mediation or arbitration is used to deal with medical malpractices; this article suggests that the opportunity of Med-Arb is obvious. However, the level of willingness and trust of applying ADR into dealing with medical malpractices is the main task of the Taiwanese society.
