劇透影片製作與集團式犯罪之家族相似性探尋

本文所稱之劇透影片，係指直接使用所欲說明劇情影片之畫面，與文字或配音為劇情說明，而對於該影片之著作權造成侵害之影片，在中國大陸有廣電總局以行政公文令各地廣電局查察禁止此種影片之上傳公開，在台灣則有受害之影片代理商對劇透影片製作者提起刑事告訴，惟此二種作為均未能制止此種影片之製作，至今仍不斷有新製作完成之影片傳輸至公開網路平台供人點閱。由於以劇透影片為經營之製作者，為能提升點擊率與名聲，對於劇透影片之製作均以「速度」、「數量」作為獲利之關鍵，是故多非獨自一人完成，而係為多數人共同為專業分工，此種多數人侵害他人財產權之行為，與集團式犯罪似有相似性，本文分別以中國大陸、台灣對於著作權侵害之處罰效果，與各該刑法對於財產犯罪之規定為分析，認為在劇透影片製作與傳輸之侵權行為，與刑法之財產法益保護相符，又依照集團式犯罪之定義，認為此種侵害之方式與集團式犯罪具有家族相似性，進而提出以集團式犯罪之訴追方式為參考，對參與劇透影片製作傳輸之行為人，均應按其參與之行為負責之結論，希能令參與影片製作者對其行為之不法性更有警覺，而漸少以此種影片之產生。 The “Spoiler Film” in this article, is one kind of revealing the plot as the main content, uses movie’s screen to re-edit it into a new Film. In order to enhance the click-through rate and reputation, the Spoiler Film maker need to operate the website as fast speed and large quantity, and it’s too hard to done by oneself, so there often have multi-person and division of labor cooperation.
