英國脫歐對於其在布魯塞爾I民商事管轄與判決執行法體系的影響

“BREXIT”and its Effects on Jurisdiction and Recognition and Enforcement of Judgments of the UK with Regard to the Brussels I Regime

英國歐盟去留公投，於2016年6月，以51.9%的比例通過脫離歐盟。英國也於2017年3月29日啟動里斯本條約第50條規定，正式展開脫歐的程序。本文以布魯塞爾I民商事管轄與判決執行法體系（Brussels I Regime下稱布魯塞爾I法體系）為中心，討論英國脫歐後於民商事管轄權與判決承認與執行的影響。 The United Kingdom European Union membership referendum voted to leave the European Union, by 51.9% for Leave. The UK also formally triggered the process of leaving the EU, aka Art. 50 of the Lisbon Treaty. This paper would offer the BREXIT effects on UK jurisdiction and enforcement of judgments rules since the UK applied the rules to Brussels I Regime for more than 40 years.
