The Anti-terrorism Law of the People's Republic of China stipulates that the anti-terrorism administrative confirmation made by the anti- terrorist agencies is non- justiciable. However, the anti-terrorism administrative confirmation is neither a state action nor a final administrative adjudication. In fact, the anti-terrorism administrative confirmation is a administrative action that can influence the rights and obligations of the recognized terrorist organizations and personnel and it should be justiciable. The Chinese law that defines the anti-terrorism administrative confirmation as non-justiciable is different from many countries around the world and it does not conform to the reality and the future development of this system. Therefore it should be revised and the anti-terrorism administrative confirmation shall be brought under judicial review. |
