The reform of the national supervision system is essentially about redistribution of power of supervision, which creates the supervisory organs and supervisory power. There are a number of constitutional designs in the Fifth-time Amendments to the Constitution that aim to put supervisory organs into the structure of the state and prescribe the relationship between supervisory organs and other state organs. In accordance with the current Constitution, the supervisory organs are created by the people's congresses to which they are responsible and by which they are supervised. And the relationship between supervisory organs and judicial organs is about checks and balances. Meanwhile, the administrative organs should not interfere the exercise of supervisory power and shall coordinate their efforts and check each other. Moreover, the supervisory organs at higher levels direct the work of those at lower levels. Therefore, it is significant to establish and maintain the relationship between supervisory organs and other state organs according to the Constitution, and the legal nature of supervisory organ and supervisory power shall be constructed on the basis of above discussion on relationships. |
