我國監察機關的憲法定位以國家機關相互間的關係為中心

國家監察體制改革實質上是監督權的重新配置,監察機關和監察權得以在此過程中產生。此次修憲為之作了頗多的憲法設計,尤其是對監察機關作為國家機構在人民代表大會制度中的地位,以及與其他國家機關的關係進行了規定。據此規定,監察機關與權力機關是“產生、負責和監督”的關係,與司法機關是“互相配合,互相制約”的關係,與行政機關則為“不受干涉,且互相配合,互相制約”的關係,上下級監察機關間則是“領導與被領導”的關係。監察機關與其他國家機關間關係的運行需以憲法為遵循,同時,對憲法上監察機關和監察權定位和性質的考察,也需通過上述國家機關間關係的討論來展開,並需注重機構設置與權力運行的實際軌跡。
英文摘要
The reform of the national supervision system is essentially about redistribution of power of supervision, which creates the supervisory organs and supervisory power. There are a number of constitutional designs in the Fifth-time Amendments to the Constitution that aim to put supervisory organs into the structure of the state and prescribe the relationship between supervisory organs and other state organs. In accordance with the current Constitution, the supervisory organs are created by the people's congresses to which they are responsible and by which they are supervised. And the relationship between supervisory organs and judicial organs is about checks and balances. Meanwhile, the administrative organs should not interfere the exercise of supervisory power and shall coordinate their efforts and check each other. Moreover, the supervisory organs at higher levels direct the work of those at lower levels. Therefore, it is significant to establish and maintain the relationship between supervisory organs and other state organs according to the Constitution, and the legal nature of supervisory organ and supervisory power shall be constructed on the basis of above discussion on relationships.
