遠洋漁船聘僱外籍船員勞動條件權益保障之研究

Research of Foreign Fishermen's Working Conditions Rights Protection in Long-haul Fishing Vessels

基於我國遠洋漁船聘僱的外籍船員曾經發生多起涉及人口販運受害事件，本文探討這些境外外籍船員勞動條件權益的保障。透過深度訪談不同立場者共20人，本文發現：境外外籍船員面臨工資偏低、工時偏長、仲介品質不一、保險不完善等問題，我國仍以命令訂定管理規範，新辦法訂有最低月工資和每日最低休息時數等。強化勞檢是落實現行保障規範的關鍵之一，可考量的勞檢手段包括結合原有的港口國檢查、公海登檢、海上／陪同觀察員等業務；還需還需跨部會合作、配置充足的勞動檢查人力等。 Due to several human trafficking incidents involving foreign fishermen in Taiwanese long-haul fishing vessels, this research intends to explore foreign fishermen's rights protection of working conditions.By adopting in-depth interviews of 20 stakeholders, this research finds the following: Encountering problems of low wages, long work-hours, intermediarty agent quality and insufficient insurance, Taiwanese government still regulates foreign fishermen's hiring by executive order, though with specification of minimum monthly wages and daily rest hours.Strengthen labor inspection is a key aspect to substantiate such protection.Possible mechanism include integrating Port Inspection, High Seas Inspection and Sea/Accompanied Observers, smoothly inter-ministerial cooperation and imposing sufficient inspectors.
