中國製造2025與著作權法立法目的完善－－《著作權法》第一條修改建議

Made in China 2025 Strategy and Improving on Legislative Intent of Copyright Law: Amending Advice on Artide 1. of Copyright Law

“中國製造2025”是未來十年國家科技事業發展的戰略舉措，同時，以智慧財產權法律制度促進科技創新是國家科技事業發展的基本方略。因此，應當釐清作為智慧財產權法重要組成部分的著作權法，促進科技事業發展的地位和作用。從科技創新的實踐需要來看，著作權法現有立法目的已不能滿足國家戰略的需要，也與科技發展趨勢和國際立法趨勢存在差距。從著作權法的學理內涵來看，著作權制度在促進科技創新中發揮重要作用，作品包含科技創新成果，權利享有保障科技創新主體權益，權利限制激勵科技創新活動，權利運行促進科技成果產業化。因此，應當明確促進科技創新是著作權法特殊的立法目的，在《著作權法》第一條中增加保護技術作品及其作者權利，和促進科技產業發展的內容。

Made in China 2025 Strategy is the core measure of our nation to develop science and technology in the next 10 years. It's the basic approach of our nation to facilitate technological innovation by the intellectual property strategy. For promoting the innovation, it's necessary to clarify the position and function of copyright law, as one of important parts of intellectual property law. From the practice requires about the innovation, the present legislative intent of Copyright Law has not been satisfied with the requirement of national strategy, and had a gap with the tendency of scientific and technological development and international legislation. From the theoretical connotation of copyright legislative system, copyright law should play an important role in illuminating innovation, which is Works including the achievements of technological innovation, the owning of rights safeguarding the interests of the innovative subjects, the restriction of rights inspiring the innovative activities, and the operation of rights improving the industrialization of scientific and technological achievements. Therefore, to promote innovation is the special purpose of copyright legislation. The next amendment should consist of the content about protecting technology works and the authors' right, and promoting the technological innovation industry.
