Some Thoughts about Legal System

本文針對法律體系概念的研究，分別探討了構成法律體系基本單位的法律規範，法律規範之間的相互關係，以及法律體系的基本特點。本文發現，法律規範有一個特點，經常被忽視，即法律規範的群體性，本文對此做了說明。在思考法律規範之間的關係時，本文認為，法律部門的概念只有“分類”的意義，且不能對司法實踐有作用。由此，本文介紹了英國學者拉茲關於法律規範之間關係的理論，即內部關係理論。在此基礎上，本文建議明確法律規範之間的縱橫坐標，以此來判斷具體法律規範的具體位置和它的重要性。最後，本文提出了法律體系的幾個基本特點。

This article focuses on the concept of legal system, and discusses the legal norm which is the basic unit of legal system, the relation of legal norms and the characteristics of legal system. Firstly, I explain the formal characteristic of legal norm which is ignored by the most scholars, is its membership. Secondly, I think that the concept of legal department is not a useful one both for legal theory and legal practice. After that, the author introduces an idea of 'internal relation' which is suggested by Joseph Raz. I am sure the idea of the internal relation can explain the relation of legal norms better. At last, I suggest a new way to think the relation of legal norms. Thirdly, I interpret the internal demands of legal system.
