中國競爭法體系完善問題研究

Research on Perfecting Issues of China's Competition Legal System

中國競爭法體系自形成以來一直處於動態發展之中，反不正當競爭法體系與反壟斷法體系的完善，以及實現競爭法體系的協調性是中國完善競爭法體系的應有之義。現階段，中國反不正當競爭法律體系的完善以修訂《反不正當競爭法》為核心，關鍵是進一步保持《反不正當競爭法》的開放性和包容性，準確把握反不正當競爭法對經營自由限制的度，並進一步實現典型不正當競爭行為構成要件的科學性。中國反壟斷法體系的完善主要透過制定反壟斷系列執法指南、構建公平競爭審查制度來實現。而中國競爭法體系的協調性則需要透過協調反不正當競爭法與反壟斷法的關係、協調反不正當競爭法與智慧財產權法、廣告法等相關法律的關係、以及協調反壟斷法與價格法、智慧財產權法等相關法律的關係來逐步實現。

China's competition legal system has been in a dynamic development process, and its perfecting depends on improvement of Anti-unfair competition legal system and Anti-monopoly legal system, achievement the coordination of competition legal system. In current days, revision of Anti-unfair Competition Law is the core of perfecting process of China's Anti-unfair Competition legal system, and will focus on maintaining the openness and inclusiveness of Anti-unfair Competition Law, accurately grasping the degree of restriction on commercial freedom from Anti-unfair competition law, and realizing the rationalization of constitutive requirement of typical unfair competition behaviors prohibited by Anti-unfair Competition Law. Perfecting process of China's Antimonopoly legal system will rely on drafting a series of guidelines for anti-monopoly enforcement, and design fair competition review system. Coordination of China's competition legal system can be gradually achieved through coordinating the relationship between anti-unfair competition law and anti-monopoly law, coordinating the relationship between anti-unfair competition law and intellectual property law, advertisement law and other relevant laws, coordinating the relationship between anti-monopoly law and price law, intellectual property law and other relevant laws.
