The provision of Cultural Heritage Preservation Law Article 97 imposes 'fines' on people. Besides, the competent authorities takes other administrative measures for administrative enforcement. This paper surveys the meaning and application of 'Non-Double Penalties Principle of a Behavior', the legal nature of 'notice of deadline improvement' and 'continuous punishment', whether the coexistence between the administrative order penalties violates the 'Non-Double Penalties Principle of a Behavior ' or not? whether the coexistence between the administrative order penalty and administrative enforcement violates the 'Non-Double Penalties Principle of a Behavior ' or not? how administrative order penalty shall be bound to the administrative enforcement? whether the existing provisions of special administrative law are confused of their types? The paper will detailedly and specificly explore the above problems, then their answer can be completely solve a clear competing relationship between the administrative order penalty and the administrative order penalty / administrative enforcement. |
