違反文化資產保存法之行政法律效果與其競合關係問題

The Administrative Legal Effects and Problems of Their Competing Relationship due to Violation of the Cultural Heritage Preservation Act

文化資產保存法第97條規定除處以『罰鍰』外，主管機關尚存有行政執行等措施可供應用。本論文探討「一行為不二罰原則」涵義及適用、『通知限期改善』及「連續處罰」之法律性質、行政秩序罰與行政秩序罰之間同時並存，有無違背「一行為不二罰原則」？行政秩序罰與行政強制執行之間同時並存，有無違背「一行為不二罰原則」？行政秩序罰與行政強制執行的種類間如何予以界分？現行特別行政法之規定有無種類混淆？本文將逐一針對上述問題予以詳細具體地予以探討，始能完整清楚解決文化資產保存法的行政秩序罰與行政秩序罰/行政強制執行之間的競合關係問題。

The provision of Cultural Heritage Preservation Law Article 97 imposes 'fines' on people. Besides, the competent authorities takes other administrative measures for administrative enforcement. This paper surveys the meaning and application of 'Non-Double Penalties Principle of a Behavior', the legal nature of 'notice of deadline improvement' and 'continuous punishment', whether the coexistence between the administrative order penalties violates the 'Non-Double Penalties Principle of a Behavior ' or not? whether the coexistence between the administrative order penalty and administrative enforcement violates the 'Non-Double Penalties Principle of a Behavior ' or not? how administrative order penalty shall be bound to the administrative enforcement? whether the existing provisions of special administrative law are confused of their types? The paper will detailedly and specificly explore the above problems, then their answer can be completely solve a clear competing relationship between the administrative order penalty and the administrative order penalty / administrative enforcement.
