海峽兩岸關係是經濟利益牽動下政治命題與法律問題的交織，隨著兩岸經濟合作的深化，雙方問題逐漸法律化。因此，未來兩岸以非具有國際法或國內法之特殊關係之架構下，可再進一步設立「兩岸仲裁委員會」或其他中介團體來解決兩岸的法律糾紛是最有可能性的選項。因此，本文從EFCA新時代的來臨，以比較法學之研究方法，提供兩岸法律衝突解決模式包括各國區際法律衝突、ECFA與WTO爭端解決機制等拙見。

Therefore, Cross- Strait may have under the construction of the special relationship in Non-international law or the national law in the future. Cross- Strait may again further to set up “Cross- Strait Arbitration committee＂ or other intermediary association , it most has the possible option to solve the Cross- Strait legal dispute. Therefore, this article from EFCA new times' oncoming, I propose the solution of pattern in Cross- Strait law conflict with the research technique of the comparative law, Including the regional conflict of laws in various countries ,ECFA and WTO by dispute settlement mechanism and so on.
