The resolutions of legal issues related to Taiwan’s Environmental Impact Assessment Act (EIAA) are basically determined by the definitive legal meaning of EIAA’s core - Environmental Impact Assessment. However, the aforesaid definitive legal meaning is greatly shaped by definer’s value judgment. This essay analyzes local people standing requirement issue and administrative decision issue to demonstrate that judicial decisions has been reached when courts conclude that EIAA prioritizes environmental value substantively. The legal reasoning and basis for awarding local people judicial standing and for deeming agency EIA examination reviewable may find its foundation, they are essentially rationalizing tools to achieve its pre-set result. |
