海峽兩岸夫妻財產關係法律適用研究

A Research on the Law Applicable to Marital Property Relationships Between the Cross-strait

夫妻財產製作為規範夫妻間財產關係的法律制度，不僅關係到夫妻共同生活的穩定，而且涉及第三人的利益與市場交易的安全。因此，世界各國家和地區對於夫妻財產制的立法均非常重視，但不同的國家與地區受不同文化傳統、政治環境等因素的影響，夫妻財產制的內容存在較大的差異。相較於合同領域的法律衝突和侵權領域的法律衝突，夫妻財產制的法律衝突問題較少被提及與研究。海峽兩岸在夫妻財產制領域一直存在法律衝突，兩地的夫妻財產關係法律適用上也因連接點等問題規定的不同而產生法律適用上的衝突，為瞭解決兩岸夫妻財產制的法律衝突，兩地均有各自的一般立法以及特殊規定。本論文擬在分析海峽兩岸夫妻財產制的法律衝突與法律適用的基礎上，分析司法實踐中該領域出現的諸多問題並給予相應的建議。

Matrimonial property system that stipulates the matrimonial property relations is one of the important parts of the family law. Because of some special factors, such as history, economy, civilization, and tradition, different countries have different matrimonial property systems. With the development of the principle of party autonomy in the marital property relations and the change of the connection point of lex personalis, increasing attentions are paid on the conflict of laws in this area. This paper demonstrates the matrimonial matters in conflicts law between the cross-strait and the law applicable to marital property relations and their solutions of the two sides of the strait.
