On the Socialization of International Investment Law－With Additional Review of the Evolving International Investment

Karl P. Sauvant教授領銜的E15倡議投資政策特別工作組在《演進中的國際投資法律與政策體制：未來路向》一文中為我們描繪出一個國際投資法制的社會化改革路徑。這一改革路徑的選擇緣於現有國際投資法制忽視國際投資的社會屬性，對東道國與國際社會的社會利益關切回應不足。因此，未來的國際投資法制改革應在兼顧不同利益相關者的利益的基礎上，引入特殊與差別待遇，構建全球共識，以其構建一個公平、透明、穩定和有效的全球性國際投資法律體制。

In the Evolving International Investment Law and Policy Regime, the E15 Initiative Task Force on Investment Policy leaded by Karl Sauvant represents socialization as a reform approach of international investment law. This approach selection is due to the disregard for the social nature of international investment and the inadequate response to the social interests of host country and international society in the current international investment law. Thus in reforming the law regime, it should give consideration to interests of different stakeholders, also include special and differential treatment, and build global consensus. Only such efforts can provide a fair, transparent, stable and effective global framework for the international invesrment.
